The petition came in the form of a petition that Samuel D. Ingham III filed in the Los Angeles Superior Court on Tuesday night.
Jamie Spears has been the curator of both her person and her estate since 2008. Montgomery has served as the singer’s temporary curator since the elder Spears stepped down due to health issues in September 2019.
In the filing, obtained by CNN, Ingham cites an injunction filed October 10, 2014 that stated Britney Spears’s “inability to consent to any form of medical treatment” as the reason why Montgomery should take over the entire conservatory.
CNN contacted Ingham on Wednesday asking him to explain why the singer can’t make medical decisions. Ingham stated that he “cannot comment on an ongoing matter”.
Jamie Spears’ attorney, Vivian Lee Thoreen, had “no comment.”
The filing asks that, in addition to seeing Spears’s medical decisions, Montgomery would be able to “restrict visitors by any means” except by meeting Ingham. It also asks that Montgomery can keep “caretakers” and “guards” for Spears.
The singer’s father was first appointed by the court as curator of his daughter’s estate in 2008, along with attorney Andrew Wallet, after a series of personal troubles publicly played out for the singer. For most of that period, he also oversaw her health and medical decisions. Jamie Spears became the sole curator of the singer’s $ 60 million estate in 2019, following Wallet’s resignation.
Ingham first filed last August to officially remove Jamie Spears as a curator. In November, the judge ruled that Spears would remain co-curator of the estate, but appointed Bessemer Trust as co-curator.
CNN has contacted Bessemer Trust for comment.
