The Caguas prosecutor’s office will today request a reconsideration of the finding that there is no ground for the arrest of Dennis Rivera Aponte, suspected of murdering his partner Ileana Rodríguez Félix in Gurabo, as they manage to set a date for the charges.

“I was talking to the Interim Prosecutor (of Caguas) Maribel Mojica and she told me that the review will be submitted in writing today. We will also work with the date for Rule 6 in height, ”De Jesús told El Nuevo Día.

The term “Rule 6” refers to the process of filing complaints in court. When the magistrate does not find a reason for the arrest of a suspect, the authorities have a second opportunity to bring the charge in a so-called “appeal hearing”, which is assigned to a different judge from the one who saw the first appeal .

De Jesús pointed out that “the three prosecutors in the case, the police investigators and the staff of the Institute of Forensic Science had already determined that they had sufficient evidence to file the case under Rule 6”.

“The jury members have a wide discretion to make a decision. In this case, unfortunately no cause was found for those two crimes, but it was found in the provision of false information. We respect it, but we disagree, ”said the officer.

“What remains is to get the new date for the hearing to re-present the evidence and present new evidence,” he added.

While he was not emphatic about what this new evidence will consist of, he did not rule out that it could consist of “an analysis still pending on the part of Forensics. We will continue to work on other matters, such as interviews and see if other visuals are available ”.

However, the head of the Caguas CIC emphasized that yesterday they had submitted enough evidence to link Rivera Pérez to the murder, including “ the ICF pathologist’s report of the cause of death, a murder with a blunt object, which hit the were not compatible with a car accident ”.
