The Chamber reminds Bukele that the constitution prohibits entry for Salvadorans at a time when people from the United Kingdom and South Africa have been ordered not to enter, following a new form of COVID-19.

“That they refrain from preventing access to the national territory of Salvadorans who are from or have been in the United Kingdom, South Africa or any other country …”.

This is the order repeated by the Constitutional Chamber to President Nayib Bukele and to the heads of the Executive Committee of the Autonomous Port, Federico Anliker, and of the Directorate-General for Migration and Foreigners, Ricardo Cucalón.

The Chamber reminds him that the constitution prohibits the entry of Salvadorans to its territory, at a time when Bukele has ordered that people from the United Kingdom and South Africa, countries affected by a new variant of COVID-19, not enter .

The magistrates remind the president and his officials that Salvadoran laws have preventive and health measures that do not imply violations of the human rights of Salvadorans.

For this reason, the House orders the Secretary of State, Alexandra Hill, to “without delay” adopt consular, diplomatic or humanitarian mechanisms for Salvadorans who are incarcerated or in a vulnerable situation in countries where traffic restrictions have been adopted ”.

Likewise, the minister must respond “quickly, effectively and collectively” to requests for information or assistance from said fellow countrymen in the consulate network.

The House will give you three working days to inform yourself about these measures.

This is the second time that the Chamber has ordered Bukele not to prevent the return of Salvadorans, after El Salvador International Airport resumed passenger flight on September 19, 2020, but the Bukele government has ordered no passengers to enter. with no evidence that the anti-covid test had been taken.

The Bukele government then ordered airlines to require testing at entry points.

However, and given Bukele’s new order not to admit passengers from the United Kingdom and South Africa, the Chamber warns that “recently registered flight suspensions and border closures could lead to the isolation of Salvadorans who are in the countries. those who have adopted these restrictions, so it is considered appropriate to take precautions to protect their situation in the face of this danger ”.
