(Reuters) – Tesla Inc has filed an appeal against a US National Labor Relations Board ruling that the electric car manufacturer has violated US labor laws, and on the agency’s orders that Chief Executive Officer Elon Musk remove a tweet from the account.

The electric car maker on Friday filed a petition with the New Orleans-based U.S. Court of Appeals to review the NLRB’s March 25 decision and order.

In the petition, Tesla asked the court to reconsider the order and grant Tesla “any further exemption that the court considers fair and equitable.”

Last month, the NRLB ordered Tesla to order Musk to remove the tweet and post a message addressing the unlawful tweet in all its facilities across the country and including language that says, “WE WILL take appropriate steps to ensure that to make sure Musk complies with our guideline. “

In the 2018 tweet, Musk wrote, “Nothing will stop the Tesla team at our car factory from voting the union. Tmrw can do that if they wanted. But why pay union fees and give up stock options for nothing? Our safety record is 2x better than when the factory was UAW and everyone is already getting health care. “

The NLRB also ordered Tesla to relocate a former employee and to repeal the 2017 rules prohibiting the distribution of union literature in its parking lot about non-working hours, and rules prohibiting the distribution of union stickers, leaflets and pamphlets without to have obtained permission first.
