Last month filed suit against the organizer of a protest outside their home in Virginia.

Erin Hawley filed the complaint against Patrick Young, an activist and part of the ShutDownDC group, which organized the protest, although Young told ABC News on Friday that he has not yet received the complaint.

A police spokesman told ABC News that a local magistrate had found “probable reason” to sue Young. It is not yet known what the possible cause is.

The complaint has been filed in a court in Fairfax County and will be made public upon receipt by Young.

Young has been charged with a felony of illegal demonstration after police told ShutDownDC at the time that it was illegal to demonstrate outside the home, ABC reported.

“When a subpoena is issued, it is outrageous that a wealthy and powerful person – a United States senator – can go to his magistrate to get a subpoena to harass a normal person,” said Young .

The protest took place on Jan. 4, two days before Congressional certification of the 2020 electoral college election, to which Josh Hawley announced he would object.

However, the senator was still in Missouri, so only Erin Hawley and one of their children were in Virginia at the time of the protest.

He had called the demonstration on Twitter and said the protesters threatened his family. However, the organizer was not charged with any threats.

The protesters were there for about 30 minutes, chanting and singing, and three of them went to the door at one point to hand in a copy of the constitution.

The police at the time they said “Didn’t think it was that important.”

The protesters left the house after police arrived, telling them that demonstrating outside the house was illegal.

Erin Hawley said she was “scared” when the protesters were outside and said they were hitting the door and shouting.
