In the lawsuit filed April 1, the man argues that repealing the law would allow him and his son to legally marry and experience a more expressive intimacy and a higher level of spirituality between them.

One of the main obstacles in this type of case, according to the Office of the City Clerk, is that official marriage permits in New York’s five counties also require information from the spouses’ biological father and mother. to establish that there are no legal impediments to marriage, which would conflict with the crime of incest that, in this case, is causing the relationship.

In the documents consulted by the local newspaper The New York Post, the context of the relationship is not known, not even the sex of those involved, it is only known that they are father and son and that they cannot reproduce, which would mean they are people of the same sex.

The father, for his part, confirms that until the law condemning incest is repealed, he will not officially ask his son to marry because “he would have to bear the emotional damage” of not being able to be legally married .
