The FBI said On Tuesday, it had arrested a man who allegedly smoked in the Capitol Rotunda during the deadly January 6 riot.
According to an FBI complaint, a witness filed videos of Greg Rubenacker, a New York man who apparently smoked in the Rotunda during the Capitol breach. Officials said the videos were posted on Snapchat by Rubenacker.
In one clip, Rubenacker reportedly said, “Holy shit! This is history! We’ve taken the Capitol!” In another segment, he reportedly said, “Smoke from the Capitol, honey.” According to the complaint, Rubenacker appeared to be smoking a marijuana cigarette and using an evaporator.
A Snapchat story that appeared to be from Rubenacker’s account showed protesters outside the Capitol with the caption “America is pissed off”.

Said the witness [they] had known Rubenacker for several years and had gone to school with Rubenacker, “was the complaint from the FBI.” Your partner also searched the New York Department of Motor Vehicles and discovered a driver’s license photo for a Greg Rubenacker. On presentation of the photo of the driver’s license, the witness stated that the photo was the same Greg Rubenacker [they] knew and had noticed in the Snapchat story. “
Rubenacker appeared in US District Court in Central Islip, NY on Tuesday, according to a video conference CNBC. He faces multiple charges related to disorderly conduct in the Capitol.
“It’s really frustrating,” Rubenacker reportedly said. “Tired of corruption in the government.”
According to CNBC, his attorney replied, “Now is not the time to talk about the case.”
Rubenacker’s case has been filed in federal court in DC, the outlet noted, as have all cases against people charged in connection with the violent riot.
