Álex Saab: they warn him that if he wants to defend himself, he must appear in the US – Investigative Unit

Alex Saab you have just received other bad news about your legal proceedings. After approval of his extradition by the Supreme Court of Cape Verde a decision of the United States Justice has just been added.

Judge Robert N. Scola, Jr. has just denied him a motion asking his attorneys for an end to his fugitive status and permission to defend himself through a special, non-physical presentation.

Scola’s response was blunt: “Saab Moran must not attack his fugitive status and the prosecution against him until he is physically present in this jurisdiction.”

EL TIEMPO was present at the hearing on March 15, requesting the motion and at this also appearing (virtually) the Saab partner, the model Camila Fabbri who moved from Caracas to Moscow a few months ago.

In line with the decision, Judge Scola dismissed Saab’s arguments ordering his lawyers to say that “he has no reason to go to the United States of his own free will” and warned that in his capacity as a Venezuelan diplomat that the government opposes his accusation.

Before the judge, Saab Moran does not mention any authority that supports that proposal.
Accordingly, the Court holds that the fugitive dissent doctrine applies in this case and prevents Saab Moran from preventing his status as a fugitive or challenging his accusation in the future. Therefore, the motion is rejected for this reason.
