The 14-page filing from Trump attorneys David Schoen and Bruce Castor states that it is unconstitutional to impeach a former president and that Trump’s comments were not directly responsible for the deadly riot at the Capitol on January 6.
The attorneys outlined the defense they will put up next week when the trial in the upper chamber begins. Senators will weigh in on a single impeachment article passed by the House last month accusing Trump of inciting insurgency with his pre-uprising remarks in the Capitol.
