The titular member of the Central Electoral Council (JCE), Dolores Fernández, stated that the most equitable, fair and egalitarian criterion for determining the order of the parties in voting and the economic distribution of political parties is the highest vote in all level of the last elections on July 5, which were presidential and legislative.
Fernández voted against resolution 01-2021, adopted last Wednesday by the JCE Plenary with a majority of four members, who determined the numerical order of the parties on the vote and the economic contribution of the resources allocated by the state , which will be based on the valid votes obtained individually by each political party at the presidential, senatorial and deputy levels.
Voice level
The JCE member believes that if the highest vote level is taken into account, four parties would have access to 80% of the economic contribution, seven would have access to 12% and 15 would have access to 8%. He indicated that when verifying the July 2020 election results, it can be seen that the parties of the Modern Revolutionary (PRM) and the Dominican Liberation (PLD) maintain a preponderance by constantly exceeding 5% at the three election levels, thus stating that they benefit from 80% of the resources allocated by the state.
However, he points out that in the case of the Dominican Revolutionary Party (PRD) and the People’s Force (FP), the special situation arises that at different electoral levels both institutions reach 5%.
“Namely, the PRD achieved 5.55% at the level of the delegations and the KP, 5.69 at the presidential level, both in the same electoral process,” he says.
He said that in these scenarios, taking a certain level as a reference could cause a rights violation, as the last election to which the law refers includes all three levels.
Leonel will appeal against it
While former president Leonel Fernández and president of the Fuerza del Pueblo party said that the JCE plenary took an “unfair, irregular and not in accordance with the constitution” decision in enacting Ordinance 01-2021 on the distribution of the economic resources of the state that determine that only the PRM and the PLD are considered a majority.
The FP leader said they will appeal to the JCE and will continue to appeal in other cases if necessary. “If the People’s Force has achieved 5% or more at the presidential level, it doesn’t matter that it has not achieved it at the congressional level, because the criterion must be what most favors the right holder …” added the former president, after realizing that the decision harms not only FP but 23 parties as well.
Bipartisanship
Meanwhile, the PRSC JCE political delegate, Tácito Perdomo, also rejected the JCE plenary’s decision. “Unfortunately, this new Council has stepped into the bipartisan way, there are sectors that have been looking for it for a long time and this Council has put itself at the service of those interests. There would be no way to justify the resolution and ordinance they supposed, ”said Perdomo.
In the field of the PRD, the leader Héctor Guzmán explained that they will wait to talk to their lawyers and then determine a position as a party and determine the actions to be taken in the future.

The regulation 01-2021 on the distribution of the economic resources of the state stipulates that only the PRM and the PLD are considered as a majority, after determining the sum of the valid votes obtained by the political parties.
As stipulated in Law 33-18 on Political Parties, Groups and Movements, 80% of the resources contributed by the state to distribute them among the political parties will be redistributed equally between the PRM and the PLD as they were the only ones. that they have cast more than 5% of the valid votes cast in those elections.
